Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides those entitled to inspect and copy a recipient's record include the parent or guardian of a minor, regardless of the minor's age, who is involved in special education services under the School Code or the "designated representative" of a student over the age of 18 involved in special education services under the School Code.
House Committee Amendment No. 1: Replaces everything after the enacting clause. Reinserts the provisions of the introduced bill with the following change. Adds a provision which specifies that the provisions of the Act that are being amended by the introduced bill shall not be construed to affect the protection of or access to records under the Illinois School Students Records Act or the federal Individuals with Disabilities Education Act.
House Floor Amendment No. 2: Provides that those entitled to inspect and copy a recipient's record include the parent or guardian of a minor, regardless of the minor's age, involved in special education services under Section 14-1.11 of the School Code, if the parent or guardian consented to mental health or developmental services on behalf of the recipient; or the "designated representative" of a student over the age of 18 involved in special education services under Section 14-6.10 of the School Code.
Senate Committee Amendment No. 1: Replaces everything after the enacting clause with the provisions of the engrossed bill with these changes. Provides that those entitled to inspect and copy a recipient's record include the parent or guardian of a minor, regardless of the minor's age, if the minor is involved in special education services under the School Code, and only for the purpose of inspecting and copying a record of the specific mental health or developmental services that the parent or guardian consented to on the recipient's behalf for special education services or the "designated representative" of a student over the age of 18 involved in special education services under the School Code.
