Amends the Illinois Municipal Code. Provides that an individual who is not a citizen but is legally authorized to work in the United States under federal law is authorized to apply for the position of police officer, subject to all requirements and limitations, other than citizenship, to which other applicants are subject. Effective January 1, 2024.
House Floor Amendment No. 1: Amends the Counties Code. Provides that a deputy sheriff or special policeman may be an individual who is not a citizen but is legally authorized to work in the United States under federal law.
House Floor Amendment No. 2: Provides that an individual who is not a citizen but is legally authorized to work in the United States under federal law who is authorized to apply for the position of police officer or sheriff shall also be subject to federal approval to obtain, carry, or purchase or otherwise possess a firearm.
Senate Floor Amendment No. 1: Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill and adds that an individual against whom immigration action has been deferred by the U.S. Citizenship and Immigration Services under the federal Deferred Action for Childhood Arrivals (DACA) process is allowed to apply for the position of police officer, deputy sheriff, or special policeman, subject to specified requirements. Effective January 1, 2024.
