This bill amends existing provisions regarding the administration of homeowner's associations (HOAs) in Idaho and introduces new regulations for the automatic conversion of HOAs to joint ownership associations (JOAs). Key amendments to Section 55-3204 include the establishment of quorum requirements for meetings, the necessity for associations to take and preserve minutes for ten years, and the stipulation that unincorporated associations must have bylaws that include specific governance requirements. Additionally, the bill specifies that if a homeowner's association violates any provisions, members who prevail in legal actions are entitled to reasonable attorney's fees.
The bill also introduces two new sections: Section 55-3204C, which outlines the automatic conversion process for HOAs to JOAs after ten years unless members vote against it, and Section 55-3214, which defines JOAs and their authority. JOAs will be able to levy assessments for maintenance of common property, obtain insurance, and enter contracts, but they will not have the authority to regulate conduct unrelated to common property. The act is set to take effect on January 1, 2027.
