This bill amends Section 18-3302J of the Idaho Code to strengthen the preemption of firearms regulation by local governments. It explicitly prohibits counties, cities, and other political subdivisions from adopting or enforcing any laws, rules, regulations, executive orders, or policies that regulate firearms in any manner, including their sale, acquisition, transfer, ownership, possession, transportation, carrying, or storage. Any such regulations will be deemed void and unenforceable, and the political subdivision may face a permanent injunction. Additionally, the bill clarifies that it is not a defense for these subdivisions to claim they were acting in good faith or on legal advice.
The bill introduces a civil penalty of $10,000 for any political subdivision that willfully and knowingly violates these provisions. It also allows the attorney general or affected individuals and organizations to pursue legal action for damages or injunctive relief against any violative regulations. Before filing such an action, they must provide written notice to the attorney general, who will have 30 days to investigate and potentially resolve the violation. The bill is declared an emergency measure, taking effect immediately upon passage and approval.
