This bill amends Section 56-275 of the Idaho Code to revise the definitions of "candy" and "soda" in relation to the Supplemental Nutrition Assistance Program (SNAP). The new definition of "candy" specifies that it is a shelf-stable preparation of sweeteners combined with various ingredients, explicitly excluding items that require refrigeration and listing specific exceptions such as baked goods, savory snacks, fruit snacks, trail mix, and various types of bars. The definition of "soda" is also updated to clarify that it includes nonalcoholic beverages with sweeteners but excludes those containing milk, beverages with over 50% juice, and several other categories, including sports drinks and oral rehydration solutions.

The bill mandates that the director of the Department of Health and Welfare request a waiver from the U.S. Department of Agriculture to exclude candy and soda from the list of eligible foods under federal regulations. If the waiver is granted, the purchase of these items with SNAP benefits will be prohibited. If not, the director is required to request the waiver annually until it is granted. The bill declares an emergency and sets an effective date of July 1, 2026.
