This bill amends Chapter 16, Title 33 of the Idaho Code by adding a new section, 33-1639, which mandates that public schools provide daily recess for students in kindergarten through grade five. The legislation requires that each school district, specially chartered district, and public charter school ensure that students in these grades receive at least one outdoor recess period of no less than twenty minutes each day, weather permitting. If outdoor conditions are unsuitable, schools must accommodate recess indoors. Importantly, the bill stipulates that recess cannot be withheld from an entire class as a form of disciplinary action.

Additionally, the bill encourages schools to offer unstructured activity breaks for students in grades six through eight. The act declares an emergency, allowing it to take effect on July 1, 2026.
