This bill amends Section 56-275 of the Idaho Code to revise the definitions of "candy" and "soda" in relation to the Supplemental Nutrition Assistance Program (SNAP). The new definition of "candy" specifies that it is a shelf-stable preparation of sweeteners combined with various ingredients, explicitly excluding baked goods, savory snacks, fruit snacks, trail mix, granola bars, and baking ingredients. The definition of "soda" is also updated to clarify that it does not include beverages containing milk, those with over 50% vegetable or fruit juice, or those requiring preparation before consumption. Additionally, it specifies that sports drinks, oral rehydration solutions, and dietary supplements are not considered soda.
The bill mandates that the director of the Department of Health and Welfare request a waiver from the U.S. Department of Agriculture to exclude candy and soda from the definition of eligible foods under federal regulations. If the waiver is granted, the purchase of these items with SNAP benefits will be prohibited. If not, the director is required to request the waiver annually until it is granted. The bill declares an emergency and sets an effective date of July 1, 2026.
