This bill amends Section 18-7108 of the Idaho Code to clarify the scope and applicability of certain legal provisions regarding property rights and government access. The amendments specify that government agents are permitted to conduct lawful investigations from public vantage points and enter private land under exigent circumstances, as well as for serving civil processes or conducting welfare checks. Additionally, the bill ensures that the use and administration of water rights, as well as the duties of the Department of Water Resources and designated watermasters, are not interfered with.
Furthermore, the bill introduces new legal language that expands the list of lawful entries by government agents, specifically adding provisions for entries authorized in sections 7-705, 40-1310, 40-2301, and 54-1230 of the Idaho Code. It also clarifies that the amendments do not increase or diminish any rights, protections, or legal authorizations concerning places of habitation and their associated curtilage. The bill declares an emergency, allowing it to take effect immediately upon passage and approval.
