This bill amends Section 74-203 of the Idaho Code to enhance the requirements for open public meetings held by governing bodies of public agencies. It stipulates that all meetings must be open to the public, prohibits decisions made by secret ballot, and allows for the use of telecommunications devices for participation. Importantly, the bill introduces new provisions that ensure individuals attending open public meetings cannot be prevented from recording these meetings, which includes capturing audio, video, or photographs. However, there are exceptions to this recording allowance for executive sessions and meetings held in facilities operated by the Idaho Department of Correction and the Idaho Department of Juvenile Corrections, as well as those conducted by the Idaho Commission of Pardons and Parole.
Additionally, the bill specifies that meetings must be held in locations free from discrimination based on race, creed, color, sex, age, or national origin. It also requires that at least one member of the governing body or a designated official must be physically present at the meeting location to facilitate public attendance. The bill declares an emergency, making it effective from July 1, 2026.
