This bill amends Section 22-1705 of the Idaho Code to update regulations concerning the production, processing, transportation, and research of industrial hemp. It emphasizes compliance with the 2018 Farm Bill and mandates that the Idaho State Department of Agriculture expeditiously promulgate rules to facilitate these activities starting with the spring 2022 growing season. The bill introduces new provisions that require establishments offering hemp products intended for human ingestion or inhalation to adhere to specific criteria, while also allowing the department to establish fees and penalties for violations.

Additionally, the bill clarifies that no penalties can be imposed without prior notice and an opportunity for a hearing, and it allows for appeals to district court regarding assessed penalties. It also stipulates that rules must be adopted through a negotiated rulemaking process and affirms that the transportation of industrial hemp in interstate commerce is permissible under existing Idaho law. An emergency clause is included, making the act effective from July 1, 2026.
