This bill repeals the existing Section 32-717A of the Idaho Code, which pertains to parents' access to records and information regarding their minor children. In its place, a new Section 32-717A is introduced, establishing clear provisions that grant each parent equal access to all records related to their minor child, including medical, educational, childcare, law enforcement, and court records, irrespective of their custodial status. Records custodians are required to provide copies of these records within fourteen calendar days of a written request, unless a shorter timeframe is mandated by law.

Additionally, the new section stipulates that access to these records can only be restricted by a court order that includes written findings demonstrating that such restrictions are necessary to prevent substantial harm to the child. It also clarifies that nothing in this section will require disclosure that violates federal law. The bill declares an emergency, making it effective on July 1, 2026.
