This bill amends Chapter 16, Title 33 of the Idaho Code by adding a new section, 33-1639, which mandates that public schools provide daily outdoor recess for students in kindergarten through grade five. The legislation specifies that each school district, specially chartered district, and public charter school must ensure that students receive at least one outdoor recess period of no less than twenty minutes each day, weather and scheduling permitting. If outdoor conditions are unsuitable, schools are required to accommodate recess indoors. Importantly, the bill stipulates that recess cannot be withheld as a form of discipline unless the behavior that warranted discipline occurred during the recess period.

Additionally, the bill encourages schools to offer unstructured activity breaks for students in grades six through eight. The act declares an emergency, allowing it to take effect on July 1, 2026.
