Additionally, prior to hiring, educational entities are required to obtain disclosure statements from applicants and their previous employers for the past ten years, specifically inquiring about any pending investigations or disciplinary actions.
The bill also stipulates that any applicant who provides false information in their disclosure statements may face immediate termination or rescission of their employment contract. Furthermore, educational entities and administrators who knowingly withhold or falsify required disclosures could face administrative penalties and professional discipline. However, they are granted immunity from civil liability for good faith disclosures. The act will take effect on July 1, 2026, following the declaration of an emergency.
