This bill amends Section 40-1406 of the Idaho Code to establish new provisions regarding the boundaries of county-wide highway districts. It specifies that if a city within a county-wide highway district annexes territory from an adjoining county, the service area of the highway district will automatically expand to include the newly annexed area. Additionally, the bill clarifies that the highway commissioners of a county-wide highway district have the authority to create ordinances and regulations necessary for their operations, which must be approved by a two-thirds majority of the commission members.
The bill also emphasizes that no city within a county-wide highway district can maintain or supervise city highways or levy taxes for their construction, repair, or maintenance. It further states that any conflicting provisions in existing Idaho laws will be superseded by this chapter. The act is declared to be an emergency measure and will take effect on July 1, 2026.
