This bill amends Chapter 65, Title 67 of the Idaho Code by adding a new section, 67-6541, which establishes regulations for the development of religious land. It defines key terms such as "group home," "heavy industrial use," "mixed-use," and "supportive housing," and outlines the applicability of these regulations. The bill mandates that cities must allow multifamily and mixed-use developments on religious land without requiring zoning changes or special approvals. It also prohibits cities from imposing certain restrictions on these developments, such as limiting building height or imposing minimum parking requirements, while still allowing for the enforcement of general sewer, water, and building codes.
Additionally, the bill specifies that cities must approve applications for multifamily or mixed-use developments on religious land if they comply with applicable regulations, and this approval process is to be ministerial. Importantly, the bill clarifies that it does not permit the construction of homeless shelters or interfere with local jurisdictions' ability to regulate them. The provisions of this section will take effect on July 1, 2026, following the declaration of an emergency.
