The amendments specify that candidates must be at least twenty-one years old, a U.S. citizen, and have been a registered elector in their legislative district for one year immediately preceding the general election. Additionally, candidates must maintain a "fixed habitation" within the district boundaries for the same one-year period prior to filing their declaration of candidacy. The bill defines "fixed habitation" as a residence where the candidate has actual physical presence and occupancy for at least 120 nights during that year. An exemption to the fixed habitation requirement is provided for candidates who have served in active military duty during the specified time frame.
The bill also includes a provision that each candidate must file their declaration of candidacy with the secretary of state and pay a filing fee of $30, which will be deposited into the general fund. The effective date for these changes is set for January 1, 2027.
