This bill amends Chapter 65, Title 67 of the Idaho Code by adding a new section, 67-6541, which establishes provisions for starter home subdivisions. It prohibits cities from enacting or enforcing ordinances that ban such subdivisions in residential zoning areas. A "starter home subdivision" is defined as a residential area of at least four acres designed to provide affordable homeownership opportunities with single-family detached homes on lots no larger than 1,500 square feet. The bill mandates that by February 1, 2027, cities with populations over 10,000 must amend their comprehensive plans and land use regulations to accommodate these subdivisions, while also outlining specific requirements regarding lot sizes, setbacks, and fees.

Additionally, the bill ensures that the new provisions do not override existing state or local laws that protect public health, safety, and welfare, including building codes and environmental regulations. It allows cities to deny approval for starter home subdivisions if infrastructure is deemed inadequate, and it permits cities to adopt less restrictive regulations than those outlined in the bill. The act is set to take effect on July 1, 2026, and includes a severability clause to maintain the validity of the remaining provisions if any part is declared invalid.
