The first section, 42-1430, approves, ratifies, and confirms the Coeur d'Alene Tribe Water Rights Settlement Agreement of 2026, which pertains to the Coeur d'Alene-Spokane River Basin Adjudication (CSRBA). It mandates that state executive branch agencies or officers execute necessary actions to implement this agreement.
The second section, 42-1765B, establishes the Coeur d'Alene Tribal Water Supply Bank, which will facilitate the off-reservation lease and rental of consumptive use federal reserved water rights held by the Coeur d'Alene Tribe. A local rental committee will be appointed to oversee this operation, allowing for the rental of water rights for beneficial use outside the reservation. The section also stipulates that rights to use water under these reserved rights may be accepted into the water supply bank to meet minimum stream flow requirements set by the water resource board. An emergency clause is included, making the act effective immediately upon passage and approval.
