The bill amends Section 22-1705 of the Idaho Code to clarify the conditions under which negligent violations related to the production, processing, transportation, and research of industrial hemp occur. It establishes that hemp producers will not be considered to have committed a negligent violation if they produce hemp solely for grain or fiber, make reasonable efforts to maintain acceptable THC levels as defined by rule, and ensure that the total THC concentration does not exceed one percent on a dry weight basis.
Additionally, the bill mandates that rules regarding industrial hemp must be adopted through a negotiated rulemaking process and allows for the continued transportation of industrial hemp in interstate commerce. The bill also includes provisions for the establishment of fees and penalties for violations, ensuring that no penalties can be imposed without prior notice and an opportunity for a hearing. An emergency clause is included, making the act effective on July 1, 2026.
