This bill amends Chapter 13, Title 39 of the Idaho Code by adding a new section, 39-1397, which establishes provisions for maternity price transparency and disclosure in hospitals. It mandates that hospitals providing labor and delivery services must ensure their price estimator portal displays a comprehensive quote for maternity episodes of care, accessible via a single click. The bill requires hospitals to create dedicated pages for both vaginal and cesarean birth episodes, detailing all-inclusive prices or itemized lists of standard services and fees, as well as common additional charges. Furthermore, hospitals must include a disclosure statement indicating that the provided prices are for uncomplicated births and do not account for unforeseen complications.
Additionally, the bill prohibits hospitals from entering contracts that restrict them from offering discounted cash prices for labor and delivery services below contracted rates or from disclosing these prices to patients. Any existing contract clauses that conflict with this provision are deemed void and unenforceable. The bill declares an emergency, making it effective on July 1, 2026.
