This bill amends Section 6-310A of the Idaho Code to enhance the process for property owners to remove unauthorized occupants from residential real property. It establishes a streamlined procedure whereby property owners or their authorized agents can request the immediate removal of unlawful occupants by submitting a verified complaint to the county sheriff. The bill outlines specific conditions that must be met for the request to be valid, including that the property is not open to the public, the unauthorized occupants are not current or former tenants, and there is no pending litigation regarding the property. Additionally, the bill modifies the fee structure for the sheriff's service of notice to vacate, changing it from a fee for serving a writ of possession restitution to a fee for service of the notice. It also allows the sheriff to charge a reasonable hourly rate for standing by to maintain peace during the removal process. The bill provides for civil action in cases of wrongful removal, allowing harmed individuals to recover damages and costs. An emergency clause is included, making the act effective on July 1, 2026.
