The bill amends Chapter 3, Title 55 of the Idaho Code by adding a new section, 55-316, which establishes limitations on rental application fees charged by property owners or managers. It stipulates that no more than two rental applicant households can be charged concurrently for a rental unit. Fees can only be charged if the property owner has a rental unit available or will have one available soon, and the applicant must be informed about the screening process before applying. Additionally, fees can only be charged for applicants requiring a criminal history and background check, and if the first applicant's application is denied, the next household can then be charged.
The bill also mandates that all rental application fees must be related to the average costs of the screening process and any other costs incurred during the application process. It clarifies that these provisions do not apply if no rental application fees are charged. The act is set to take effect on July 1, 2026, and includes a declaration of emergency to expedite its implementation.
