This bill amends the Idaho Building Code Act by introducing a new section, 39-4109C, which allows local governments to permit single stairway designs in certain residential group R-2 apartment buildings under specific conditions. These conditions include limitations on the number of stories, dwelling units per floor, and construction types, as well as requirements for fire safety measures such as automatic sprinkler systems, fire-rated openings, and smoke detection systems. The bill also stipulates that no more than two buildings on a single lot can utilize this single exit design, and it mandates that all other applicable local building codes must be adhered to.
Additionally, the bill amends Section 39-4116 to clarify the authority of local governments in adopting and enforcing building codes. It specifies that local governments must comply with the provisions of the chapter and allows them to amend certain codes to address local concerns, provided that such amendments maintain an equivalent level of safety. The bill also exempts agricultural buildings from the requirements of the enumerated codes and establishes guidelines for the issuance of permits related to these structures. An emergency clause is included, making the act effective on July 1, 2026.
