The proposed bill, known as the "Conversational AI Safety Act," introduces a new chapter to Title 48 of the Idaho Code, establishing regulations for operators of conversational AI services. It defines key terms, including "account holder," "conversational AI service," and "minor," and outlines specific operator requirements. Operators must disclose when users are interacting with AI, particularly to minors, and must implement protocols to address sensitive topics such as suicidal ideation. Additionally, the bill mandates that operators take measures to prevent the generation of inappropriate content for minors and to avoid misleading users into believing they are conversing with a human.
The bill also stipulates penalties for non-compliance, including civil penalties of up to $1,000 per violation, with a cap of $500,000 per operator. Enforcement of these provisions will be the responsibility of the attorney general, and the bill clarifies that it does not create a private right of action for individuals. The act is set to take effect on July 1, 2027.
