This bill amends Section 18-7039 of the Idaho Code to enhance the legal protections for police dogs, police horses, search and rescue dogs, and accelerant detection dogs. It introduces a new definition for "electronic storage detection dog," which refers to dogs trained to locate electronic storage devices by scent. Additionally, the bill clarifies existing definitions for various types of police dogs, including bomb detection dogs, narcotic detection dogs, patrol dogs, and tracking dogs. The language has been updated to replace "which" with "that" in several definitions for consistency and clarity.
The bill establishes penalties for individuals who willfully and maliciously harm these animals, categorizing severe offenses as felonies punishable by up to five years in prison or fines up to $10,000. Lesser offenses, such as throwing objects at these animals or interfering with their duties, are classified as misdemeanors with penalties of up to one year in prison or fines up to $1,000. Furthermore, convicted individuals are required to make restitution for veterinary bills, replacement costs, and lost salary of the peace officer associated with the harmed animal. The bill also includes a provision exempting peace officers and veterinarians from liability when euthanizing an animal to relieve undue pain or suffering. An emergency clause is included, making the act effective on July 1, 2026.
