This bill introduces new chapters to Title 67 and Title 6 of the Idaho Code, focusing on privacy and safety in restrooms and changing facilities within government buildings and places of public accommodation. Chapter 48 of Title 67 mandates that all multi-occupancy restrooms and changing facilities in government buildings be designated for use by either males or females only, prohibiting individuals from entering facilities designated for the opposite sex. It also outlines exemptions for single-occupancy facilities and provides for reasonable accommodations for individuals unable to use designated facilities. Additionally, it establishes a civil cause of action for individuals who encounter members of the opposite sex in these spaces, allowing for monetary damages and attorney's fees.

Chapter 40 of Title 6 similarly imposes duties on places of public accommodation to ensure the privacy and safety of individuals in restrooms and changing facilities. It outlines the same exemptions and reasonable accommodations as Chapter 48, while also establishing liability for places of public accommodation that fail to protect individuals from members of the opposite sex. Both chapters preempt any conflicting laws or regulations and include provisions for severability, ensuring that if any part of the act is deemed invalid, the remaining sections will still be enforceable. The act is set to take effect on July 1, 2026.
