This bill amends Chapter 1, Title 33 of the Idaho Code by adding a new section, 33-144, which establishes provisions for Cardiac Emergency Response Programs (CERP) in schools. The bill defines key terms such as "automated external defibrillator" (AED), "cardiac arrest," and "cardiac emergency response plan." It mandates that starting in the 2026-2027 school year, all public school districts and charter schools in Idaho must develop a CERP that outlines the steps for responding to cardiac emergencies on school grounds. The CERP must include evidence-based standards and ensure that AEDs are accessible within three minutes of recognizing a cardiac arrest. Additionally, appropriate school staff must be trained in first aid, CPR, and AED use.
The bill also requires schools with athletic programs to have specific CERP provisions for incidents occurring during athletic events. AEDs must be clearly marked and accessible at athletic venues, and all coaches are required to maintain training in CPR and AED use. The state department of education and local school boards are tasked with monitoring compliance with these requirements. Furthermore, local school boards may accept donations for purchasing and maintaining AEDs, and individuals adhering to the provisions of this section are granted immunity from civil liability. The act is set to take effect on July 1, 2026, due to the declared emergency.
