This bill amends Chapter 2, Title 20 of the Idaho Code by adding a new section, 20-251, which establishes regulations regarding unmanned aircraft systems (UAS) near Department of Correction facilities. The new section defines key terms such as "correctional facility," "mitigation measures," "nefarious manner," and "restricted airspace." It allows the Department of Correction and law enforcement to take necessary actions, including electronic interference, against UAS operating in a nefarious manner within a designated restricted airspace, provided these actions do not conflict with federal law. The bill also mandates that the Department of Correction post notices indicating that the area is a "Drone No Fly Zone."
Furthermore, the bill makes it unlawful to operate a UAS within the restricted airspace of a correctional facility, classifying such an act as a misdemeanor punishable by a fine of up to $1,000, imprisonment for up to six months, or both. Additionally, the court may order the forfeiture of the UAS involved in the unlawful act. Operators of unmanned aircraft systems are held responsible for being aware of airspace restrictions, and ignorance of these restrictions is not a valid defense. The bill declares an emergency and sets an effective date of July 1, 2026.
