This bill amends Chapter 2, Title 20 of the Idaho Code by adding a new section, 20-251, which establishes regulations regarding unmanned aircraft systems (UAS) near Department of Correction facilities. The new section defines key terms such as "mitigation measures," "nefarious manner," and "restricted airspace," specifically outlining the airspace around correctional facilities where UAS operations are restricted. It grants the Department of Correction and law enforcement the authority to take necessary actions, including detection, tracking, and interception of UAS that are suspected of operating in a harmful manner within this restricted airspace.

Furthermore, the bill makes it unlawful to operate a UAS within the restricted airspace of a correctional facility, classifying such an act as a misdemeanor punishable by fines ranging from $2,000 to $5,000 or imprisonment for up to one year. The court is also mandated to order the forfeiture of any UAS involved in the unlawful act. Additionally, operators of UAS are held responsible for being aware of airspace restrictions, and ignorance of these restrictions will not serve as a defense against prosecution. The bill declares an emergency, making it effective from July 1, 2026.
