This bill amends Chapter 2, Title 20 of the Idaho Code by adding a new section, 20-251, which establishes regulations regarding unmanned aircraft systems (UAS) near Department of Correction facilities. The new section defines key terms such as "mitigation measures," "nefarious manner," "proximity," and "restricted airspace." It grants the Department of Correction and law enforcement the authority to take necessary actions, including detection, tracking, and interception of UAS that are suspected of operating in a harmful manner within two nautical miles of correctional facilities. The bill also mandates that the Department of Correction post notices indicating that these areas are "Drone No Fly Zones."
Furthermore, the bill makes it unlawful to operate a UAS within the restricted airspace of a correctional facility, imposing fines ranging from $2,000 to $5,000 or imprisonment for up to one year for violations. Additionally, any UAS used in connection with such unlawful acts will be subject to forfeiture. The bill emphasizes that operators of unmanned aircraft systems must be aware of airspace restrictions, and ignorance of these restrictions will not serve as a defense against prosecution. An emergency clause is included, making the act effective on July 1, 2026.
