This bill amends Section 22-1002 of the Idaho Code to include a definition for "chickens" as domesticated fowl raised primarily for residential, noncommercial production of eggs or meat, and introduces a new section, 22-1003, which establishes provisions regarding chicken ownership. The new section asserts that the right to farm, including chicken ownership, is a natural right in Idaho and prohibits any deed restrictions or homeowner association rules from entirely banning chicken ownership. However, it allows for reasonable regulations concerning the housing and pasturing of chickens, as long as they do not impose undue burdens on homeowners.

Additionally, the bill specifies that chicken ownership rules apply only to single-family dwellings and do not extend to multifamily units or properties smaller than a quarter acre. It also clarifies that existing local ordinances will take precedence over this section, and the provisions do not apply to agricultural zones or properties where local regulations already permit poultry keeping. The bill includes a severability clause and declares an emergency, making it effective on July 1, 2025.
