This bill amends Section 22-1002 of the Idaho Code to include a definition for "chickens" as domesticated fowl raised primarily for residential, noncommercial production of eggs or meat, and introduces a new section, 22-1003, which establishes provisions regarding chicken ownership. The new section asserts that the right to farm, including chicken ownership, is a natural right in Idaho and prohibits any deed restrictions or homeowner's association rules from entirely banning chicken ownership. However, it allows for reasonable regulations concerning the housing and pasturing of chickens, as long as they do not impose undue burdens on homeowners.
Additionally, the bill specifies that chicken ownership rules apply only to single-family dwellings on lots of at least a quarter acre and do not extend to multifamily units or properties in agricultural zones where local regulations permit poultry. It emphasizes the responsibility of chicken owners to educate themselves about chicken health and management. The bill also includes a severability clause and declares an emergency, making it effective on July 1, 2025.
