This bill amends Chapter 37, Title 39 of the Idaho Code by adding a new section, 39-3704, which establishes provisions regarding directed blood product transfusions. The new section defines "blood product" to include whole blood, blood plasma, blood derivatives, blood platelets, and blood clotting agents. It prohibits health care providers or facilities from preventing patients from providing their own blood or that of a directed donor for transfusions, with certain exceptions. These exceptions include situations where the donation or transfusion would be harmful, where there is insufficient time to arrange for the blood product before a medical procedure, or in cases of emergency medical services.
Additionally, the bill provides immunity from liability for health care providers or facilities using blood products provided by patients, unless gross negligence is proven. It also clarifies that the new provisions do not conflict with existing federal laws regarding blood product collection and use. The bill declares an emergency, making it effective on July 1, 2025.
