The bill stipulates that public utilities cannot provide service for these new large loads from existing resources or those planned for general ratepayers within the next ten years. Instead, costs associated with the new service can only be recovered from the specific customer requesting it, ensuring that other ratepayers are not burdened with these costs.

Additionally, the bill allows electric consumers to procure electric service for new large loads from entities other than the designated public utility, promoting competition in the supply of electric services. The Idaho Public Utilities Commission is granted the authority to create rules to implement these provisions and resolve disputes, while ensuring that no cost shifts occur to other customers. The bill also clarifies that providing electric service under these provisions does not grant any unfair advantages or create unreasonable differences in rates or services. An emergency clause is included, making the act effective on July 1, 2025.
