This bill amends Title 33 of the Idaho Code by adding a new Chapter 68, which establishes provisions regarding the immigration status and nationality of students in Idaho's public educational institutions. The chapter defines key terms such as "accredited institution of higher education," "elementary and secondary schools," and "immigration status," which encompasses various categories of individuals, including citizens, permanent residents, non-immigrants, undocumented immigrants, refugees, and asylees.

Under this new chapter, all Idaho public educational institutions, including elementary and secondary schools as well as accredited higher education institutions, are required to record the immigration status and nationality of all enrolled students. Additionally, these institutions must publish aggregated demographic data, including immigration status and nationality, and report this information annually to the superintendent of public instruction, who will then make it available on the state department of education's website. The bill declares an emergency, making it effective from July 1, 2025.
