This bill amends Chapter 65, Title 67 of the Idaho Code by adding a new section, 67-6512A, which establishes requirements for conditional use permits specifically for the construction of energy facilities. Under this new provision, each governing board must require a conditional use permit for any energy facility, as defined in section 67-2352. The bill mandates that a condition be attached to each permit, requiring the energy facility to first offer the electricity generated to local electric suppliers that serve Idaho consumers before offering it to other suppliers. The electricity must be offered at the market price at the time of the offer.
Additionally, the bill stipulates that any conditional use permit granted for an energy facility that does not comply with these provisions will be considered void. The provisions outlined in this section will remain in effect until July 1, 2030, after which they will be null and void. The bill declares an emergency, making it effective starting July 1, 2025.
