This bill amends Idaho law to establish new provisions aimed at protecting property rights, specifically regarding the removal of unauthorized persons from residential real property. A new section, 6-310A, is introduced to allow property owners or their authorized agents to request the immediate removal of individuals unlawfully occupying their property under certain conditions. These conditions include the requirement that the property is not open to the public, the unauthorized occupants are not current or former tenants, and there is no pending litigation related to the property. The process involves submitting a verified complaint to the county sheriff, who is then responsible for serving a notice to vacate and restoring possession to the property owner.

Additionally, the bill introduces two new sections under Chapter 36, Title 18, Idaho Code, addressing criminal activities related to real property. Section 18-3621 makes it a misdemeanor to present false documents with the intent to unlawfully detain real property, while Section 18-3622 establishes that knowingly selling or leasing property without legal authority constitutes a felony. The bill declares an emergency, making it effective from July 1, 2025.
