Additionally, the bill outlines that this presumption can only be rebutted by demonstrating that the scientific basis for the warning is not supported by the clear weight of scientific evidence and that the manufacturer or seller was aware or should have been aware of this at the time of sale. Evidence to challenge the adequacy of the warning must be peer-reviewed, published in a recognized academic journal, replicable, and reflect reliable scientific principles. The bill declares an emergency and is set to take effect on July 1, 2025.
