This bill amends Chapter 2, Title 34 of the Idaho Code by adding a new section, 34-221, which mandates that the Secretary of State investigate claims of false information published about candidates during election campaigns. Candidates who believe they have been the subject of false claims can report these to the Secretary of State, who is required to investigate. If the claim is found to be verifiably false, the party that published the information will have seven days to respond, or 48 hours if the finding occurs within two weeks of an election. The Secretary of State must then post the findings on their website by the end of the next business day.

Additionally, the bill defines the term "publish" to encompass communication through various mediums, including telephone, radio, television, internet, or written forms. The bill declares an emergency, stating that it will take effect on July 1, 2025.
