The bill amends Section 67-827A of the Idaho Code to enhance the security measures for the Idaho Office of Information Technology Services by requiring criminal history checks for prospective employees and contractors who provide information technology (IT) services to external state agency customers. The criminal history checks will be based on a completed ten-finger fingerprint card or scan and will include information from both the Idaho Bureau of Criminal Identification database and the Federal Bureau of Investigation's criminal history database. The bill specifies the IT disciplines that will be subject to these checks, including IT network engineering, software engineering, information security engineering, and data science, among others.
Additionally, the bill updates the numbering of the sections within the law, specifically deleting the previous subsection (11) and replacing it with a new subsection (12) that allows for the promulgation and adoption of reasonable rules, subject to legislative approval, to effectuate the purposes of the act. The bill declares an emergency, making it effective on July 1, 2025.
