The bill amends Chapter 20, Title 16 of the Idaho Code by adding a new section, 16-2013A, which establishes provisions for postadoption contact agreements. These agreements are defined as documents created before the finalization of an adoption that outline the ongoing relationship between adoptive parents, birth parents, and the adopted child. To ensure enforceability, all parties must have the opportunity to consult with a licensed attorney before signing, and the agreement must be approved by the court and filed upon finalization of the adoption. The bill also specifies that such agreements cannot limit the adoptive parent's ability to move out of state and can be modified with mutual consent or court order if deemed in the child's best interest.

Additionally, the bill clarifies that violations of these agreements do not provide grounds for setting aside an adoption or for monetary damages. It emphasizes that the existence of a postadoption contact agreement is not a prerequisite for finalizing an adoption, and refusal to agree to one cannot be used against any party in adoption proceedings. The court that approves the agreement will maintain jurisdiction over any modifications, terminations, or enforcement issues related to the agreement. The act is set to take effect on July 1, 2025, due to an emergency declaration.
