This bill amends Idaho Code to include a new definition of "human sexuality" and establishes requirements for parental permission regarding instruction on this topic in schools. Specifically, it adds a definition that encompasses various aspects of human sexuality, including sexual conduct, sexual orientation, and gender identity. Additionally, it introduces a new section, 33-1611A, which mandates that school districts notify parents or legal guardians at least two weeks prior to any instruction addressing human sexuality. Parents must provide written permission for their child to attend such instruction, and alternative educational options must be provided for those without permission.
Furthermore, if a child receives instruction without the required permission, parents can notify the school board and either grant retroactive permission or request rectification. The school board is obligated to respond within thirty days, and if they fail to do so, parents may pursue legal action. The bill also allows parents who prevail in such actions to recover statutory damages and other forms of relief. An emergency clause is included, making the act effective on July 1, 2025.
