This bill amends Chapter 3, Title 41 of the Idaho Code by adding a new section, 41-351, which establishes provisions regarding cost-sharing requirements for health benefit plans. The bill defines "cost-sharing requirement" to include copayments, coinsurance, deductibles, and annual limitations on cost-sharing for specific health care services. It mandates that when calculating an enrollee's contribution to these costs, insurers must consider amounts paid by both the enrollee and any third parties on their behalf. The provisions of this section will apply to health benefit plans that are entered into, amended, extended, or renewed on or after January 1, 2026.

Additionally, the bill specifies that the new cost-sharing requirements do not apply to prescription drugs if a medically appropriate generic equivalent is available and deemed suitable by the patient's doctor. The Department of Insurance is granted the authority to create rules to implement these provisions, subject to legislative approval. The bill declares an emergency, making it effective from July 1, 2025.
