The bill amends Section 67-5292 of the Idaho Code to establish a sunset review process for administrative rules. It replaces the term "review" with "sunset" and mandates that each rule chapter in effect on July 1, 2026, undergo a sunset review on a staggered schedule between July 1, 2026, and June 30, 2034, with subsequent reviews every eight years thereafter. The office of the administrative rules coordinator is tasked with establishing and posting this schedule on its website and on the cover page of each rule chapter by January 1, 2026.
Additionally, if an agency intends to renew a rule chapter before its sunset date, it must prepare a statement for the legislature detailing the statute or federal regulation the rule implements, the necessity of the rule's substantive content, and the rationale for its continuation, including evidence of its benefits relative to costs. The agency must also consider whether the substantive content would be better integrated into Idaho Code rather than remaining as a separate administrative rule. The bill includes new considerations for the agency, such as the expected cost to monitor and enforce the rule. An emergency clause is included, making the act effective on July 1, 2025.
