This bill amends Idaho Code Sections 33-1609 and 33-1611 to introduce new definitions and requirements regarding instruction on human sexuality in schools. It defines "human sexuality" to encompass a broad range of topics, including sexual conduct, sexual orientation, and gender identity. Additionally, the bill mandates that parental permission is required for any instruction addressing human sexuality. Schools must notify parents at least two weeks in advance of such instruction and provide them with the opportunity to review instructional materials. If parents do not provide written permission, alternative educational options must be offered to the child.

Furthermore, the bill establishes a cause of action for parents or guardians if their child receives instruction on human sexuality without the required permission. It allows parents to provide retroactive permission or seek rectification from the school board if such instruction occurs without consent. If a parent prevails in a legal action against the school district for violations of these requirements, they may recover statutory damages, actual damages, and other legal relief. The bill declares an emergency, making it effective on July 1, 2025.
