The proposed bill amends the Idaho Residential Mortgage Practices Act by adding a new section, 26-31-211A, which aims to enhance consumer privacy in mortgage applications. This section defines "mortgage trigger lead" and outlines prohibited practices related to the solicitation of consumers for residential mortgage loans based on such leads. Specifically, it mandates that solicitors must clearly disclose their lack of affiliation with the original lender or broker, inform consumers that their personal information was obtained without the lender's knowledge, comply with federal prescreening solicitation requirements, and refrain from contacting consumers who have opted out of prescreened offers or are on "do-not-call" lists.

Additionally, the bill establishes that violations of these provisions will be considered violations of the Idaho Consumer Protection Act. The legislation declares an emergency, making it effective from July 1, 2025.
