The bill amends the Idaho Residential Mortgage Practices Act by adding a new section, 26-31-211A, which establishes consumer privacy protections in mortgage applications. It defines "mortgage trigger lead" and outlines prohibited practices for soliciting consumers for residential mortgage loans based on information from these leads. Specifically, it requires solicitors to clearly disclose their lack of affiliation with the original lender or broker, the use of personal information obtained without consent, and compliance with federal regulations regarding prescreened solicitations. Additionally, it prohibits solicitors from contacting consumers who have opted out of prescreened offers or are on "do-not-call" lists.
Violations of this new section will be considered violations of the Idaho Consumer Protection Act. The bill declares an emergency, making it effective on July 1, 2025.
