The bill amends the Idaho Residential Mortgage Practices Act by adding a new section, 26-31-211A, which establishes consumer privacy protections in mortgage applications. It defines "mortgage trigger lead" and outlines prohibited practices for soliciting consumers for residential mortgage loans based on such leads. Specifically, it mandates that solicitors must clearly disclose their lack of affiliation with the original lender or broker, inform consumers that their personal information was obtained without the lender's knowledge, comply with federal prescreening solicitation requirements, and refrain from contacting consumers who have opted out of prescreened offers or are on "do-not-call" lists.

Violations of this new section will be considered violations of the Idaho Consumer Protection Act. The bill also declares an emergency, making it effective on July 1, 2025.
