The bill amends Chapter 70 of Title 18 of the Idaho Code by adding a new section, 18-7045, which establishes the crimes of impeding a strategic facility and strategic facility trespass. Impeding a strategic facility occurs when a person knowingly and intentionally disrupts its operations, with penalties ranging from a misdemeanor to a felony depending on the extent of damage or economic loss caused. Strategic facility trespass is defined as entering or remaining on a strategic facility or its construction site without permission, with penalties escalating for repeat offenses. The bill also outlines exceptions to these offenses, such as lawful engagement in regulatory processes or ownership of the land.

Additionally, the bill defines "strategic facility" to include various critical infrastructures, such as refineries, power plants, telecommunications infrastructure, and military facilities, among others. It specifies that individuals or organizations that aid in committing these crimes may face significant fines, and strategic facilities can pursue civil actions for damages. Importantly, the bill clarifies that it does not apply to public demonstrations or expressions of free speech protected under the U.S. or Idaho constitutions. An emergency clause is included, allowing the act to take effect immediately upon passage and approval.
