This bill amends Chapter 5, Title 21 of the Idaho Code by adding a new section, 21-515B, which mandates the installation of light-mitigating technology systems on wind energy conversion systems. Starting July 1, 2025, any new wind energy conversion system must apply to the Federal Aviation Administration (FAA) for approval to install such a system before commencing commercial operations. If approved, the installation must be completed within 24 months. Additionally, from January 1, 2026, existing systems that began operations without this technology must also apply for installation and complete it within 60 months of receiving FAA approval.
The bill outlines the responsibilities of developers, owners, or operators regarding the installation and maintenance of these systems, which are intended to reduce the impact of facility obstruction lighting while ensuring aircraft safety. It also requires these parties to notify the Idaho Transportation Department's Division of Aeronautics about the progress of the installation and any delays. The costs associated with the installation and maintenance of the light-mitigating technology system will be borne by the developers, owners, or operators of the wind energy conversion systems. An emergency clause is included, allowing the act to take effect immediately upon passage and approval.
