The proposed bill amends Chapter 6, Title 48 of the Idaho Code by adding a new section, 48-603H, which establishes regulations regarding the disclosure of communications involving artificial intelligence (AI). It defines it as an unfair and deceptive trade practice for any entity to interact with consumers using chatbots or AI technologies without clearly notifying them that they are not communicating with a human. The bill outlines specific conditions under which this practice is considered deceptive, including the lack of clear notification and the nature of the communication being more complex than basic operational information.

Additionally, the bill grants consumers the right to initiate private legal action against violators, allowing them to seek damages or statutory damages, whichever is greater. It also empowers the attorney general to pursue injunctive relief against non-compliant entities, with penalties including a minimum civil penalty of $10,000 and additional fines for each violation. The bill includes provisions for the recovery of legal costs for the prevailing party in any related litigation. An emergency clause is included, making the act effective on July 1, 2025.
