The bill outlines specific conditions under which such practices are considered misleading, including the lack of clear notification and the nature of the communication exceeding basic operational information.

Additionally, the bill provides consumers with the right to initiate private legal action against violators, allowing them to seek damages or statutory damages of $1,000, whichever is greater. In class action cases, damages may be awarded up to $10,000. The attorney general is also empowered to seek injunctive relief against non-compliant entities, with penalties including a minimum civil penalty of $10,000 and $1,000 for each violation. The bill includes provisions for the recovery of reasonable costs and attorney's fees for the prevailing party in any legal action. An emergency clause is included, making the act effective on July 1, 2025.
