This bill amends the Idaho Code regarding county fair boards by repealing the existing Section 22-202A, which previously designated county fair boards as advisory bodies. It introduces a new Section 22-202A that establishes provisions for advisory fair boards, allowing them the option to either remain as advisory bodies to the board of county commissioners or to petition to become a separate board that operates under the new provisions. The petition process requires the signatures of a majority of the advisory fair board members and must be submitted to the clerk of the board of county commissioners.

Upon receiving a petition, the board of county commissioners is required to publish a notice in a local newspaper for at least two weeks, announcing a hearing on the petition. The fair board can be removed from its advisory capacity and operate under the new provisions if a majority of the board of county commissioners and a three-quarters majority of the fair board members vote in favor. The bill declares an emergency, making it effective on July 1, 2025.
