This bill repeals the existing Section 22-202A of the Idaho Code, which previously designated county fair boards as advisory bodies. In its place, a new Section 22-202A is introduced to establish provisions for advisory fair boards. The new section allows any fair board that currently serves as an advisory body to the board of county commissioners to either continue in that capacity or petition to become a separate board that operates under the new provisions.

The petition process requires the signatures of a majority of the advisory fair board members and must be submitted to the clerk of the board of county commissioners. Upon receiving the petition, the board of county commissioners is mandated to publish a notice in a local newspaper and hold a hearing on the petition within a specified timeframe. The fair board can transition from its advisory role to a separate board if approved by a majority vote of the county commissioners and a three-quarters majority vote of the fair board members. The bill declares an emergency, making it effective on July 1, 2025.
