This bill repeals the existing Section 22-202A of the Idaho Code, which previously designated county fair boards as advisory bodies. In its place, a new Section 22-202A is introduced to establish provisions for advisory fair boards. The new section allows any fair board that currently serves as an advisory body to either continue in that capacity or petition to become a separate board that operates under the new provisions.
To initiate the transition from an advisory body to a separate board, a petition must be submitted, signed by a majority of the advisory fair board members, to the clerk of the board of county commissioners. Following the submission, the board of county commissioners is required to publish a notice of the petition in a local newspaper and hold a hearing on the matter. The fair board can only be removed from its advisory role and operate under the new provisions if a majority of the county commissioners and a three-quarters majority of the fair board members approve the change. The bill declares an emergency and sets an effective date of July 1, 2025.
