The proposed bill amends Chapter 3, Title 55 of the Idaho Code by adding a new section, 55-315, which establishes limitations on rental application fees charged by property owners or managers. The legislation aims to reduce the financial burden on rental applicants by restricting the number of households that can be charged concurrently to two per rental unit. Additionally, property owners or managers can only charge these fees if they have a rental unit available or expected to be available within 60 days, and they must disclose the criteria for tenant acceptance prior to accepting applications.
Furthermore, the bill stipulates that rental application fees can only be charged to legal adults within the applicant household and must be related to the actual costs of processing the application and conducting background checks. If the application of the first household is denied, the property owner or manager may charge the next household, provided that no more than two households are charged at the same time. The bill also clarifies that these provisions do not apply if no rental application fees are charged. An emergency clause is included, making the act effective on July 1, 2025.
