The proposed legislation, known as the "Motor Voter Act," amends Section 34-404 of the Idaho Code to facilitate the registration of eligible voters at driver's licensing offices. Under the new provisions, the Idaho Transportation Department, through the Division of Motor Vehicles, will register eligible electors who apply for a driver's license or identification card. These offices are required to complete a registration application for each eligible elector and forward the completed applications to the county clerk's office on a weekly basis, as well as on the business day prior to the closing of registration. Additionally, the legislation allows electors the option to opt out of this automatic registration process.

The bill also makes adjustments to the existing structure of voter registration by renumbering certain subsections and clarifying the process for recording political party affiliations or unaffiliated designations. The county clerk will maintain records of these affiliations, and the poll book for primary elections will include this information to ensure that unaffiliated electors can declare their preferred primary ballot. The act is set to take effect on July 1, 2025, following the declaration of an emergency.
